• A violation of the standard of care – Often a patient is not treated as per the standard norms due to certain reasons:
  • Unavailability of proper devices for providing services and tracking system.
  • Improper training to the staff.
  • Ignorance on the part of the staff due to lack of supervision and accountability.

• An injury caused by the negligence – Certain medical malpractices occur due to ignorance on part of the service provider, greed for money, including the doctors and the nurses. Often due to their negligence, a patient instead of recovering gets affected by another ailment. Still the law cannot held the doctor for negligence, because, they try to mold it their way. For e.g.: These days doctors insist patients to go under knife for delivery instead of natural delivery citing that if any complication occur during natural birth, they shouldn’t be held responsible. Doctors has the prefer this method because in that case they can earn more money through OT charges, hospital admission and visiting fees. While in natural birth their commission is reduced, since the procedure is of shorter duration.
• The injury resulted in significant damages -Many a times, due to doctor’s or staffs’ negligence a patient suffers. Despite that people fear to file any charges against the institution or the staffs because
