Two areas of professional liability that I believe, pose the most serious legal threat for a physician in a medical practice would be:

a. Liability for undertaking any malpractices

b. A breach of medical information

In the case of liability for undertaking any malpractices, the liability could be severe on the part of the physicians as may involve the compensation to the patients in terms of large amount of money. This further risks the reputation of the entire medical fraternity. Hence a defensive approach is adapted in the practice by the physicians with the biggest threat of litigation.

In case of breach of medical information, the privacy of patient’s data is compromised, putting the onus mainly upon the Healthcare provider or the physicians who share the data with the Health staff. This is in fact one of the most critical issues pertaining to the Patient’s rights, especially with regards to the ‘Privacy bills of rights. The evolution of technology has made it now feasible to misrepresent the medical facts of the case for millions of patients stored into the electronic records quite spontaneously. Hence a major threat.
