Ans: The most difficult aspect while probing sexual harassment allegation by an employee will be to gather evidence of the crime and witnesses for the claim. The plaintiff must prove that the defendant made unwelcome advances or actions that amounted to sexual harassment. In most of the cases, it is very difficult to prove the act, if the act was not caught on CCTV camera or witnessed by someone who bore the testimony of it. In many cases, witnesses turn hostile to avoid the wrath of perpetrators who in most of the cases are senior members of the organization / family or group. The victim also, is reluctant to come out in open to avoid the negative consequences like social stigma or hampering of future job prospects as a result of taking on the high and mighty. Some choose to keep silent to avoid the uncomforting and painful investigation process that follows the filing of a case. It is the victim’s determination to bring the culprit to the book, that decides how successful the case will be, in addition to all other factors.
