How does the strict liability doctrine differ from negligence.
Expert Answer
Answer
Difference:
- In case of Strict liability, the person only needs to show the harm that was caused and defendant is responsible for the same. In case of negligence, the defendant needs to prove that it was due to negligence and not intentional
- The penalty in case of strict liability is much higher compared to negligence
- The strict liability generally is governed by written laws which is not the case in negligence
